1. Introduction & Overview
Welcome to Safety Inspections & Compliance. These Terms and Conditions (“Terms”) govern the provision of all health, safety, access, and electrical inspection, testing, and compliance services provided by Safety Inspections & Compliance (“we”, “us”, or “our”), operating from Ashford, Kent.
By engaging our services, requesting a quotation, or allowing our personnel on site, you (“the Client” or “Duty Holder”) agree to be bound by these Terms.
2. Statutory & Regulatory Framework
Our services are conducted in accordance with relevant United Kingdom health and safety legislation and technical standards, including but not limited to:
- The Health and Safety at Work etc. Act 1974
- The Electricity at Work Regulations 1989 (EAWR)
- The Work at Height Regulations 2005 (WAHR)
- The Lifting Operations and Lifting Equipment Regulations 1998 (LOLER)
- The Provision and Use of Work Equipment Regulations 1998 (PUWER)
- BS 7671 (IET Wiring Regulations) and BS 7883:2019
3. Services Provided
We provide professional safety inspection, testing, risk assessment, and compliance reporting services. The specific scope of work, location, and fees for each project will be outlined in a separate Written Order, Quotation, or Service Agreement.
4. Client Obligations & Site Access
To enable us to carry out our services safely and efficiently, the Client agrees to:
- Provide Access: Ensure full, safe, and unobstructed access to all relevant areas, installations, fixed plant, and equipment at the agreed date and time.
- Documentation: Supply all necessary historical technical files, previous EICR reports, structural drawings, and operation manuals prior to commencement.
- Site Hazards: Inform our inspectors of any known site-specific hazards, hazardous materials (including asbestos registers), or operational restrictions before work begins.
- Isolations: Facilitate required power or system isolations where dead-testing or structural examinations require de-energisation or temporary shutdown.
If access is denied, delayed, or deemed unsafe by our engineers upon arrival, we reserve the right to charge an abortive visit fee.
5. Inspections, Reports & Classifications
- Independent Verification: All inspections and tests are conducted objectively by qualified competent persons. We do not alter findings, pass criteria, or safety classifications to suit commercial preferences.
- Defect Classifications: Findings will be classified strictly under standard UK regulatory codes (e.g., EICR Codes C1, C2, C3, FI, or BS 7883 Pass, Conditional Pass, Conditional Fail, Fail).
- Immediate Danger (C1 / Action Required): Where an immediate danger to life or property is identified during an inspection, our engineers reserve the right to tag out, isolate, or notify site management immediately in accordance with statutory obligations.
- Delivery of Reports: Formal inspection certificates, System Technical Files, and EICR documentation will be issued electronically upon receipt of full payment for the rendered services, unless agreed otherwise in writing.
6. Quotations, Fees & Payment Terms
- Quotations: All written quotations remain valid for 30 days from the date of issue.
- Pricing & VAT: Rates are quoted in Pounds Sterling (£) and are subject to VAT at the prevailing rate where applicable.
- Payment Terms: Invoices are due for settlement within 30 days from the invoice date, unless alternative credit terms have been agreed in writing.
- Late Payment: We reserve the right to charge interest and administrative recovery costs on overdue accounts pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.
7. Cancellation & Rescheduling
- Client Cancellation: Cancellations or rescheduling requests made more than 48 hours prior to the scheduled appointment will incur no penalty.
- Late Cancellation: Cancellations made within 48 hours of the scheduled start time may be subject to a cancellation fee equal to 50% of the quoted service value.
- Abortive Visits: If our engineers attend site but are unable to carry out the work due to lack of access, uncooperative site conditions, or missing isolations, the visit will be billed at 100% of the agreed daily/service rate.
8. Limitation of Liability
- Scope of Inspection: Inspection reports and certificates reflect the physical condition of the tested equipment and systems at the precise time of testing. We accept no liability for damage, wear, or alterations occurring after the inspection date.
- Consequential Loss: To the maximum extent permitted by English law, Safety Inspections & Compliance shall not be liable for any indirect, special, or consequential loss, loss of profit, business interruption, or loss of production arising from our services.
- Liability Cap: Our total liability in contract, tort (including negligence), or statutory duty shall be strictly limited to the total fee paid by the Client for the specific service giving rise to the claim.
- Statutory Exceptions: Nothing in these Terms limits or excludes our liability for death or personal injury caused by our proven negligence, or for fraud.
9. Intellectual Property & Document Ownership
All inspection templates, methodologies, compliance frameworks, and generated reports remain the intellectual property of Safety Inspections & Compliance. Upon receipt of full payment, the Client is granted a non-exclusive, perpetual licence to use the inspection certificates and reports for site compliance, legal auditing, and insurance purposes.
10. Confidentiality & Data Protection
Both parties agree to treat all business information, site layouts, security arrangements, and compliance data as strictly confidential. We process all personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
11. Governing Law & Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
Both parties agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claim arising from these Terms.
